Copyright Notices

We at Koinup support copyright laws. We respect intellectual property and ask our members to do the same. We don't allow anyone to post content protected by copyright. So we ask our members to upload only works that they own or which they have obtained the rights to use.

As a platform based on user-generated content, we do not have the chance to preview or approve all user submissions. So we cannot have prior knowledge of any copyright infringement hosted on our servers. But we do guarantee that we do everything reasonably possible to take down all material that infringes copyright as soon as we come across it.

Users remain the owners of all the works they submit to Koinup, so they are liable for all the copyright infringements relating to their works. Koinup as the service provider network is not liable for copyright infringements stemming from user content.

As outlined in our Terms of Use, user submissions are viewable only in streaming format. Downloading of the files onto any physical support and/or hardware (such as pc hard-disks, xboxes, playstations, portable consoles, mp3 readers) is not allowed.

We reserve the right to delete the account of a repeat copyright infringer. We define a repeat copyright infringer as a member whose works have been taken down from our server more than twice

Copyright infringement procedure

If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you must provide the Koinup Copyright Agent with written notice containing the following information:

  • The name, address, and electronic signature of the complaining party
  • Full details of the infringing materials and their exact location in Koinup
  • Sufficient information to identify the copyrighted works
  • A statement by the owner that in good faith there is no legal basis for the use of the materials in question
  • A statement of the accuracy of the notice and, under penalty of perjury, that the complaining party is authorized to act on the behalf of the owner.

Once notice is given to the service provider, or in circumstances where the service provider discovers the infringing material itself, it is required to expeditiously remove, or disable access to, the material. Safe harbor provisions do not require the service provider to notify the individual responsible for the allegedly infringing material before it has been removed, but they do require notification after the material is removed.

On receiving notification containing the above information, we will immediately remove the material that is alleged to be infringing copyright and we will then forward the notice to the alleged infringer. Koinup will take all commercially reasonable steps to promptly notify the subscriber that his/her content has been removed.

Counter Notice

Subscribers may provide Koinup with a Counter Notice. To be effective, a Counter Notice must be given in writing and sent to Koinup's designated Copyright Agent, and include at least the following:

  • An electronic or physical signature of the Subscriber;
  • A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  • A statement made under penalty of perjury that the Subscriber believes in good faith that the material was removed or disabled as a result of a mistake or a misidentification of the material to be removed or disabled;
  • Subscriber consent to local court jurisdiction or, if overseas, to an appropriate judicial body

On receiving a Counter Notice containing the above information, we will promptly provide the Complaining Party with a copy of the Counter Notice; we will inform the Complaining Party that it will reinstate the removed material or cease disabling access to it within ten (10) business days; we will reinstate access to the removed material within ten (10) to fourteen (14) business days following receipt of the Counter Notice, provided the Koinup designated Copyright Agent has not received notice from the Complaining Party that an action has been filed seeking a court order to restrain the Subscriber from engaging in an infringing activity relating to the material on Koinup, and further provided that the disputed material does not violate any of Koinup other terms of use.
